Where2Wheel, LLC (“Where2Wheel,” “Company,” “we,” “our,” or “us”) provides a crowd-sourced trail directory and interactive map, an online community for off-road enthusiasts, and a platform for purchasing tickets, camping reservations, and other event-related services from off-road parks and operators (collectively, the “Services”).
By accessing or using our website, mobile applications, or any other Where2Wheel services (collectively, the “Platform”), you agree to these Terms of Service (“Terms”) and our Privacy Policy [link]. If you do not agree, do not use our Platform.
1. Eligibility
You must be at least 16 years old to use the Platform. If you are under 18, you may use the Platform only with the consent of a parent or legal guardian. By using the Platform, you confirm that you meet these requirements.
2. Changes to the Terms
We may update these Terms at any time. We will notify you by posting the new Terms on the Platform and/or by email. Continued use of the Platform after updates means you accept the changes.
3. Scope of Services
The Platform includes:
- Crowd-sourced map & trail listings (submitted by users and third parties).
- Community forums & media sharing (photos, videos, discussions, maintenance tips).
- Off-road park listings and ticket/camping/event sales (offered by third-party operators).
- Event hosting & booking tools.
We do not guarantee the accuracy, legality, or safety of any trail, park, or event listed. Users are responsible for confirming access rights, conditions, and safety.
4. Accounts & Security
When creating an account, you must provide accurate information. You are responsible for maintaining the confidentiality of your login credentials and all activity under your account. Notify us immediately of any unauthorized use.
5. Payments, Refunds & Cancellations
- Membership fees, if applicable, are billed according to the plan you select and are non-refundable except as required by law.
- Event tickets, camping reservations, or park access passes are subject to the refund/cancellation policy of the event or park operator. Where2Wheel is not responsible for refunds unless we are the merchant of record.
- If we process payment for a third-party park or event, we do so as their agent; they remain solely responsible for the event’s operation and safety.
6. User Content & License
You retain ownership of the content you submit (“User Content”), but you grant Where2Wheel a worldwide, perpetual, royalty-free license to use, reproduce, modify, adapt, publish, publicly display, distribute, and promote your User Content in connection with the Services, including for marketing purposes.
You represent that:
- You own or have the right to post the content.
- The content complies with these Terms and all applicable laws.
- You have permission to share any trail, land, or park location you post.
7. DMCA Copyright Policy
If you believe content on the Platform infringes your copyright, notify our designated agent:

8. Content Standards & Prohibited Uses
You may not post or transmit content that is illegal, harmful, infringing, obscene, defamatory, harassing, misleading, or promotes unsafe or unlawful activity.
You may not:
- Misrepresent trail or land access rights.
- Post GPS data for private property without permission.
- Interfere with the operation of the Platform.
- Use the Platform for commercial purposes without our consent.
9. Map & Data Disclaimers
Trail data, conditions, and access rights are user-generated and may be inaccurate, incomplete, or outdated. Where2Wheel does not verify or guarantee accuracy. Users must independently confirm legality and safety before traveling to any location.
10. Assumption of Risk & Release
Off-roading, camping, and related activities involve significant risks, including injury, death, and property damage. By using the Platform and attending events or visiting parks found through it, you voluntarily assume all such risks.
You agree to release and hold harmless Where2Wheel, its owners, employees, and affiliates from all claims arising from your participation in any off-road, camping, or related activities, whether or not organized or advertised on the Platform.
11. Third-Party Parks & Events
We list parks and events operated by independent third parties. We are not responsible for their acts, omissions, conditions, or policies. Your participation is subject to their terms and waivers.
12. Limitation of Liability
To the fullest extent permitted by law, Where2Wheel is not liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of the Platform or participation in any activity listed on it.
13. Indemnification
You agree to defend, indemnify, and hold harmless Where2Wheel from claims, damages, losses, and expenses (including legal fees) arising from your use of the Platform or violation of these Terms.
14. Dispute Resolution & Class Action Waiver
You agree to resolve disputes through binding arbitration in Virginia under the AAA Commercial Arbitration Rules. You waive the right to participate in class or representative actions.
15. Governing Law & Venue
These Terms are governed by the laws of the Commonwealth of Virginia. Any court proceedings outside arbitration will be in Virginia Beach, VA.
16. Severability & Entire Agreement
If any provision is found invalid, the rest remain in effect. These Terms and our Privacy Policy are the entire agreement between you and Where2Wheel.
